Downwinders' Day in Court Starts at the Library

Innovation Synopsis
Where can a cancer survivor prove she lived in the path of nuclear fallout 70 years ago? In July 2025, Congress expanded the Radiation Exposure Compensation Act (RECA) to cover all of Utah, acknowledging for the first time that Cold War atmospheric nuclear testing sickened Salt Lake Valley residents. Survivors and their families may now claim $100,000, but only with proof of residency between 1951 and 1962. For most, that proof exists in exactly one place: the paper pages of the R.L. Polk & Company City Directories preserved at The City Library. Our Nonfiction/AV librarians built a certified documentation service, with attorney-vetted letters, embossed copies, no appointments, and no charge, that transforms a historic reference collection into federal legal evidence. In under a year, the library has documented residency for more than 400 downwinders, supporting over $40 million in compensation claims. To date, every claim filed with the library's documentation has been accepted.
Challenge/Opportunity
When RECA expanded to cover Salt Lake County in July 2025, it created an impossible-sounding requirement: claimants must prove at least 12 consecutive months of residency between 1951 and 1962, 65 to 75 years after the fact.
- Most claimants are elderly cancer survivors, or the children of parents who have died. School, utility and employment records from the era are gone.
- Claims must be filed by Dec. 31, 2027, so speed matters.
- Federal guidance is ambiguous; claimants arrive anxious, grieving and unsure what will "count."
- Many file by mail and need certified paper documentation, not digital files.
The opportunity: the library's complete run of Polk city directories, listing every adult resident by name and address, year by year, is the single most reliable residency record that survives. NFAV staff devised a two-directory method proving a full year of residency, built certification tools, and worked with a RECA attorney to ensure every document meets federal requirements.
Key Elements of Innovation
This innovation fuses a historic paper collection, modern certification technology and librarian-designed legal procedures:
- Two-directory lookup method: staff locate a claimant in consecutive annual Polk directories, establishing the required 12 months of residency.
- Certification workflow: desktop scanner, library embosser and an attorney-vetted certification letter make copies admissible for federal claims, developed with a RECA specialist attorney.
- Walk-in model: no appointments, no fees. Staff are trained and ready whenever a downwinder arrives.
- Backup sources: when directories fall short, staff mine microfilmed newspapers and other holdings with Periodicals staff.
- Regional referral hub: health systems and downwinder advocates across Utah list The City Library as the place to get residency proof; staff also fulfill requests by phone and email from across the nation.
This innovation is cutting-edge because it is analog: only a library with physical archives could do it.
Achieved Outcomes
-400+ downwinders documented, representing more than $40 million in compensation applied for, at no cost to any patron.
- 100% acceptance: per the partnering RECA attorney, every claim filed with the library's documentation has been accepted.
- Formal tracking began in February 2026; the library maintains a running count of RECA claimants served.
- The first patron, a prominent local broadcaster and cancer survivor, received full compensation and now publicly champions the library as the place to start a claim.
- New partnerships: a RECA specialist attorney trained NFAV staff and vetted procedures; health care systems and advocacy groups statewide now route claimants to the library.
- Staff have become so fluent they recognize a downwinder within moments, which patrons say immediately puts them at ease. Most leave the same day with everything they need.
- With the Dec. 2027 filing deadline ahead, impact will keep compounding through 2027.
